Woman Spits On, Kicks La Grange Officers: Police

LA GRANGE, IL – A woman suspected of stealing a phone from a La Grange restaurant server ended up spitting on and kicking arresting officers, police said.

Erika A. Ortiz, 34, of Chicago, was charged with aggravated battery of a police officer, theft of services and resisting a police officer, authorities said.

Through a public records request, Patch obtained the police report.

About 8:30 p.m. July 5, officers were called about Ortiz, a customer at Barrel House Social 100 W. Burlington Ave. Ortiz was found at the nearby Metra station.

Placed under arrest, Ortiz tried to break free and spit on an officer, police said. She also accused officers of manhandling her and being racist.

Once she was put in a squad car, Ortiz spit on another officer and kicked her, according to the report.

The restaurant’s video showed Ortiz, who was sitting at the bar, unplugging a server’s phone and putting it in her pocket, police said.

Ortiz did not pay her bill, with her credit card declined, police said.

Restaurant employees told police that Ortiz had asked them to use their phones so that she could log into her Facebook and TikTok accounts. They refused.

Outside the restaurant, a server confronted Ortiz about the phone and warned that if Ortiz did not give it back, the employee would call the police, the report said.

Ortiz told police that the server was ridiculing her.

In an interview, Ortiz described herself as a “smart ass” and that she did not know her saliva would hit the officers. She denied kicking anyone.

Ortiz was taken to the Cook County Jail.
